Terms of Use for the CreateFloorplan.com Service
§ 1 Preliminary Provisions
This Regulation below defines the rules for providing services by the Service Provider through the CreateFloorplan.com computer system, as well as the rules for using these services and protecting the User's personal data.
Before starting to use the Service, the User is obliged to familiarize themselves with this Regulation.
The CreateFloorplan.com website, available at www.rzutmieszkania.pl, is operated by InfoImagine, headquartered in Warsaw.
§ 2 Definitions
Service Provider - Infoimagine with its registered office in Warsaw, tax identification number (NIP) 8881454891, National Business Registry Number (REGON) 140752384.
User - any entity or individual who in any way uses the Service.
Service - software provided in the SaaS (Software as a Service) model, either for a fee or free of charge by the Service Provider at the website www.createfoorplan.com
Service - an electronic service provided by the Service Provider to the Service Recipient, providing access to the functionalities of the Service.
Regulation - this regulation of the Service.
§ 3 Liability
The Service Provider undertakes to provide the Service with due diligence.
The Service Provider does not guarantee the fulfillment of the Customer's expectations through the use of the Service in their business activities.
The Service Provider reserves that the System is provided to the User "as it is," that is, in its current state. The development and updating of the System depend on the policy adopted by the Service Provider.
The Service Provider shall not be liable, to the widest extent permitted by law, for disruptions, including interruptions in the operation of the Service caused by force majeure, unauthorized actions of third parties, or incompatibility of the Service with the User's technical infrastructure.
Access to the Service is possible from any computer with an internet connection. It is recommended to use newer versions of web browsers.
§ 4 Out-of-Court Complaint Resolution and Claims
Detailed information regarding the User's options for using out-of-court complaint resolution and claims enforcement methods, as well as the rules for accessing these procedures, is available at the offices and websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodship Inspectorates of Trade Inspection, and at the following internet address of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl. The User has the following example options for using out-of-court complaint resolution and claims enforcement: a) The User is entitled to contact the permanent consumer arbitration court referred to in Article 37 of the Act of December 15, 2000, on Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to resolve the dispute arising from the Agreement concluded with the Service Provider. b) The User is entitled to contact the voivodship inspector of the Trade Inspection in accordance with Article 36 of the Act of December 15, 2000, on Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and the Seller. c) The User can obtain free assistance in resolving the dispute between them and the Service Provider by also using the free assistance of the district (municipal) consumer ombudsman or social organization whose statutory tasks include consumer protection (including the Federation of Consumers, the Association of Polish Consumers).
§ 5 Final Provisions
All agreements concluded through the Service Provider are made in Polish.
The Service Provider reserves the right to make changes to the Regulation for valid reasons, such as changes in legal regulations, changes in payment methods, to the extent that these changes affect the implementation of the provisions of this Regulation.
Matters not regulated in this Regulation are subject to the generally applicable provisions of Polish law, in particular, the Civil Code; the Act on the provision of electronic services; the Consumer Rights Act, the Personal Data Protection Act.
The User has the right to use out-of-court complaint resolution and claims enforcement methods. For this purpose, they can submit a complaint through the European Union's online dispute resolution platform available at: http://ec.europa.eu/consumers/odr/.
